2.6. We cannot guarantee that our Website and our services are available without interruption and without error. In the event of an interruption, Cbdologic will contact the user to identify an appropriate solution.

3. Registration, User Account and Personal Data

3. 1 Online Ordering Process
The ordering process includes the following steps:
> The user  selects the product(s) he or she wants to purchase.
> The user goes to the virtual shopping cart.
> The user is asked to create a customer account or to log into his or her existing customer account, when applicable.
> The user fills in a form with the information needed for identification and order processing: title, first name, surname, billing address, shipping address, phone number, email address.
> The user is asked to select a method of payment and to proceed to a secure page for online payment.
> The user confirms his or her order by clicking on the corresponding button. Then, the order is sent to the company.
> The company receives notification of the payment and the user receives confirmation of payment.
> The order is firm when the company receives the user’s payment.
> The company acknowledges receipt of the order by sending an electronical mail that includes a copy of the order to the user.

Password creation: Prior to placing an order on the Website, the user must create an account on the registration page. During the registration process, the user is asked to choose a username and a password. The usermust handle the username and password in strictest confidence.

Cbdologic shall not be deemed liable for any misuse of the registration information and will presume that the person using our Website is the rightful registered user

3.2. Cbdologic and our employees will never ask for your password. If you suspect that your registration information has fallen into the wrong hands, you are required to change your registration information without any delay.

3.3. Account Information As a user you represent and warranty that all the information of your account is correct and current. Cbdologic accepts no responsibility with regard to any delay or additional costs caused by incorrect or inaccurate information provided by the user.

3.4. All personal data of the user is governed and protected by Cbdologic as outlined in our privacy policy.

4. Contract and Ownership

4.1. The products shall remain the exclusive property of the company until they are paid in full. The retention of title of the company shall also apply, where required, to the resale price or a portion of the resale price of these products, as well as to the insurance compensation which would be subrogated. The user shall take any necessary measure to duly inform his or her creditors in due time.

4.2. The offer of products on this Website shall not be considered an offer by Cbdologic to enter into a contract. As products may not necessarily be available at any moment, the user does not immediately conclude a purchase contract by placing an order.

4.3. By confirming your order, the order becomes legally binding and shall remain legally binding for a period of 7 (seven) business days. The simple confirmation of the receipt of the order by Cbdologic does not constitute the conclusion of a contract.

4.4. Errors and omissions may occur despite all precautions taken to ensure that all the information and specifications featured on our Website or in other written documents are accurate. We reserve the right to correct the information at our sole discretion and to update or cancel an order that is or may be affected by such corrections.

4.5. An agreement shall be deemed to be established between Cbdologic and the user upon shipment of the ordered products. Cbdologic reserves the right to refuse totally or partially the conclusion of a contract without providing a reason.

4.6. If the order of a user  is cancelled, restricted or suspended, Cbdologic will make every reasonable effort to contact the user to explain the situation.

5. Costs and Terms of Payment

5.1. All prices quoted by Cbdologic on our Website or in other written documents include VAT. All costs included in the purchase price are clearly featured. Any additional cost will be disclosed separately and shall be paid by the user. 

5.2. The products are dispatched by Cbdologic. Customs and import duties and other related costs shall be borne by the user Cbdologic has no impact on these additional costs and is not able to provide information with regard to these costs. For more information, please contact the customs authorities of your country of destination.

5.3. The purchase price is due in advance by the user and will be required as soon as the contract is established. The products will not be delivered to the user before receipt of the full purchase price. In the event of a delay in payment, Cbdologic reserves the right to terminate the contract without prior notice.

5.4. The methods of payment that we accept are specified on the Website. We reserve the right to modify these methods at any moment and at our sole discretion. We leave it up to the user to check all related information on our Website.

6. Delivery

6.1. The products are usually delivered to the shipping address provided by the user in the purchase order within 2 to 5 business days, insofar that the products in question are available, and depending on the terms of the chosen delivery and the area of delivery. For shipment to some countries, a longer delivery time may apply; please visit our Website for more information. All terms of delivery are not legally binding and failure to meet these terms does not give you the right to terminate the contract.

6.2. If the Cbdologic delivery is late, the user agrees to grant us an additional period of 20 (twenty) business days during which we can fulfill the contract before the user  can terminate the contract. In the event of the termination of the contract, Cbdologic shall not refund more than the purchase price. Cbdologic shall not be held liable for compensation in the event of a late delivery of products or a failure to deliver the products.

6.3. The user shall accept partial shipments if, for example, a portion of the products ordered is no longer available or can only be shipped at a later date.

6.4. Advantages and risks are passed to the user upon shipment of the products ordered. Cbdologic shall not be held liable for any loss or damage to the products during transportation. 

7. Warranty and Return Policy

7.1. The user shall inspect the products immediately upon receipt and inform Cbdologic in writing of any defect within 5 (five) days; failure to do so shall be considered as acceptance of the products. Hidden defects shall also be disclosed in writing to Cbdologic within 5 days following their discovery.

7.2. All products of Cndologic are made with natural ingredients and are subject to natural variations. In the event of variations (in color, smell, taste, etc.), we shall not be held liable.

7.3. All products are offered on an « as is » basis. Varying images, information or descriptions of products on our Website or in other documents written by Cbdologic shall not be considered a guaranty of specific features.

7.4. Defective products shall be shipped back to CENTRE LOGISTIQUE DE DISTRIBUTION SARL 1223 Voie Christophe Colomb, Alpespace, 73800 FRANCIN, France. Cbdologic reserves the right to either replace the products or refund the purchase price. In the event of a refund of the purchase price, import taxes shall not be refunded. Cbdologic shall not be held liable for any loss borne by the user as a result of defective products.

7.5. If you are not satisfied with your order, you can return the products to Cbdologic within 14 (fourteen) days of receipt of the products. Please contact the customer service in a timely manner. To the extent possible, the products shall be returned sealed, unopened, unused, undamaged and in their original packaging. Upon receipt of the products and if the aforementioned terms are complied with, the purchase price shall be refunded; return shipping costs shall be borne by the user. 

7.6.Disclaimer / Limitation of Liability

1. To the extent permitted by law, in no event shall Cbdologic or any other company affiliated with Cbdologic be liable for damages or loss arising out of or related to these Terms and Conditions or the products or the services offered by Cbdologic.

2. The user agrees that the use of products and services offered by Cbdologic is at his or her sole risk and not open to appeal.

The customer is required to check the most current version of these Terms and Conditions before placing an order

8. Miscellaneous

8.1. If any of the provisions included in these Terms and Conditions shall be deemed partially or totally invalid, unlawful, void or unenforceable, the validity and enforceability of any remaining provision shall not be affected. Any invalid, unlawful or unenforceable provision shall be replaced by a valid and enforceable provision that is as close as possible to the initial intention of the parties.

8.2. The contract between Cbdologic and the user,  which includes these Terms and Conditions, shall be exclusively governed and construed in accordance with Swiss substantive law, to the exclusion of conflict of law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

8.3. Any dispute arising out of or related to the contract between Cbdologic and the user and/or these Terms and Conditions (including their valid acceptance) shall be expressly governed by the courts located at the place of business of Cbdologic.

9- Intellectual Property

Any element, feature, content and functionality on the Cbdologic website is and shall remain the intellectual and exclusive propriety of the company Cbdologic. The reproduction, exploitation or use, for any purpose, even partially, of any element, feature, content and functionality of the website, including but not limited to any photo, logo, visual or text, is forbidden.
